The situation

A construction defect claim usually involves three specialists: somebody to determine what failed, somebody to price the repair credibly, and somebody licensed to perform it. Splitting those across three vendors invites contradiction, and opposing counsel lives on contradiction.

Merrill holds all three under one California license. That is a genuine structural advantage in litigation and it is completely invisible unless the brand explains it, because from the outside it reads as a firm that does several unrelated things.

What we found

The audience is not one audience. Attorneys, carriers, public agencies, and HOAs retain the firm for different reasons and judge it on different things. Counsel wants an opinion that survives a Daubert challenge. An HOA wants the water intrusion to stop.

The most persuasive fact was buried in the principal's history. Ted Merrill has worked nearly every position on a site: labourer, apprentice, journeyman carpenter, superintendent, estimator, licensed contractor. That progression is the reason a cross examination on means and methods goes nowhere, and it is far more convincing than any credential list.

The decision

Make the overlap the position. The headline states it as a sequence: we build it, we price it, and we testify to it. Three verbs that only work together, which is exactly the argument.

Segment the audience without fragmenting the brand. Four client types, each with its own explanation of what changes, on a single page rather than four separate journeys.

Publish the fee schedule. Unusual in expert witness work, and it removes the largest friction in the first call while signalling confidence.

What we chose not to do. Trade offs are the interesting part of any project, so we publish ours.

  • We did not lean on the years alone. Seventy two years stated without explanation reads as an old firm. Attached to a specific argument about defensibility, it becomes an asset.
  • We did not simplify the technical language on the service pages. Attorneys are the buyer and they are not intimidated by detail.
